These Terms and Conditions (“Terms”) govern the relationship between Kukhula Projects (Pty) Ltd (“Kukhula Projects”, “we”, “our”, “us”) and our clients (“you”, “your”) when engaging our construction, renovation, or commercial cleaning services. By requesting a quotation, signing a contract, or making payment, you agree to these Terms.
1. Services Provided
Kukhula Projects provides home renovations, building, construction, and commercial cleaning services in accordance with the agreed scope of work, quotation, and contract.
Any changes or additions to the scope must be agreed upon in writing and may result in additional costs and extended timelines.
Work is carried out during normal business hours unless otherwise agreed.
2. Quotations & Estimates
All quotations are valid for 30 (thirty) days from the date of issue, unless otherwise stated.
Quotations are based on the information provided by you. Any variation in specifications, materials, or project requirements may lead to a revised quotation.
Estimates are not final costs and may be adjusted based on site conditions, materials, and client requirements.
3. Payments
A deposit (percentage specified in the quotation/contract) is required before work commences.
Progress payments may be required depending on project size and timeline.
Final payment is due upon project completion and handover.
Late payments may attract interest charges and suspension of work until payment is received.
4. Client Responsibilities
You are responsible for:
Providing accurate project or service details and site access.
Ensuring that the site is free of hazards and safe for our staff and subcontractors.
Obtaining any necessary approvals, permits, or consents required for the project or cleaning service (unless otherwise agreed).
5. Materials, Equipment & Subcontractors
Kukhula Projects may use trusted subcontractors, suppliers, and cleaning agents where necessary.
Materials and equipment supplied remain the property of Kukhula Projects until full payment has been received.
If you supply your own materials, products, or equipment, we are not responsible for defects, delays, or additional costs arising from them.
6. Warranties & Quality
We are committed to delivering workmanship and services of a professional standard.
Any defects caused by faulty workmanship within the warranty period stated in the contract will be rectified at no additional cost.
For cleaning services, satisfaction issues must be reported within 24 hours of service completion for review and rectification.
Warranties do not cover wear and tear, misuse, neglect, unauthorised alterations, or damages beyond our control (e.g., weather events, structural issues, unsuitable cleaning surfaces).
7. Delays
Project and cleaning timelines are estimates and may be adjusted due to weather, supply chain issues, access restrictions, or unforeseen circumstances.
We will communicate any significant delays as soon as reasonably possible.
8. Liability
Kukhula Projects is not liable for indirect, consequential, or incidental damages arising from our services.
For cleaning services, we are not liable for damage to items that were not disclosed as delicate, improperly maintained, or unsuitable for standard cleaning methods.
Our total liability for any claim is limited to the value of the contract.
You are responsible for ensuring adequate insurance coverage for your property during the project or cleaning service.
9. Termination
Either party may terminate the agreement with written notice if the other party materially breaches these Terms.
In the event of termination, you remain liable for payment of all completed work, services rendered, materials purchased, and associated costs up to the termination date.
10. Compliance with Laws
Kukhula Projects complies with all relevant South African building regulations, labour laws, health & safety standards, and cleaning industry practices. Clients are also required to comply with applicable legal and regulatory requirements.
11. Dispute Resolution
Any disputes will first be addressed through negotiation in good faith.
If unresolved, disputes may be referred to mediation or arbitration in accordance with South African law.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa.
